Terms of Service

1. Who these terms are for

These terms apply between Timo Scholz-Fritsch, BlastRev, Kaiserallee 12, 58511 Lüdenscheid, Germany (“BlastRev”, “we”) and every business that installs the BlastRev app in a Shopify store (“you”). BlastRev is offered to businesses only, not to consumers. Shopify’s own terms continue to apply to your Shopify store and to billing through Shopify.

2. What BlastRev does

BlastRev lets you build product quizzes from your Shopify catalog, show them in your store, connect results to Klaviyo, and see which quiz results lead to orders. The current features are described in the app and on this website. We may improve and change features; we will not remove a core feature you pay for without telling you at least 30 days in advance, and you may cancel in that case.

3. Plans and prices

Free: free, without time limit; 1 live quiz and 100 completed quizzes per month. Starter: USD 29 every 30 days; unlimited live quizzes and 2,000 completed quizzes per month. Growth: USD 79 every 30 days; unlimited live quizzes and 10,000 completed quizzes per month. Paid plans are billed by Shopify on your Shopify invoice; taxes are added where Shopify charges them. Your first paid plan starts with a 14-day free trial, once per store. If you cancel during the trial, you pay nothing; if you switch plans during it, the new plan keeps only the days left.

There are no setup fees and no charges per completion. When a month’s completed quizzes are used up, your quizzes keep working; new completions are simply not counted, linked to orders or sent to Klaviyo until the month resets or you choose a bigger plan. We never upgrade or charge you without your approval in Shopify.

We may change prices with at least 30 days’ notice by email or in the app. A new price applies from your next billing period after the notice period. If you do not agree, you can cancel before it takes effect.

4. Cancelling

There is no minimum term. You can switch to Free in the app’s settings at any time, or uninstall the app. A paid plan then ends immediately and Shopify refunds the unused days of the current period. When you switch to a plan with a live-quiz limit, your most recently edited live quizzes stay live up to that limit and the others return to draft; nothing is deleted. If Shopify pauses your paid plan, for example because your store is paused or a Shopify bill is unpaid, Free limits apply until Shopify reactivates it, and your plan then returns on its own.

5. Your content and data

Your quizzes, texts, catalog data and results belong to you. You give us the right to use them only to run BlastRev for your store. When you uninstall the app, your store data is deleted as described in our privacy policy.

You are responsible for the content of your quizzes and recommendations, including that they do not make misleading health, medical or efficacy claims, and for your store’s privacy policy and cookie banner. Our templates give general care direction only and you may edit them.

6. Data protection

Where BlastRev processes personal data of your customers for you, we do so as your processor under our data processing agreement (DPA), which forms part of these terms. You can request it at support@blastrev.com.

7. Fair use

Please do not use BlastRev to break the law, to collect data without the consent it requires, to send spam, or to attack, overload or reverse engineer the service. If you do, we may suspend the affected feature after telling you, or immediately where needed to protect other merchants or shoppers.

8. Availability and support

We work to keep BlastRev available and fast, but cannot guarantee uninterrupted operation, for example during maintenance or outages of Shopify or our hosting provider. Support is by email at support@blastrev.com; we aim to answer within one business day.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for breaches of essential obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely, and then limited to the damage typically foreseeable when the contract was made. Otherwise our liability for slight negligence is excluded. The same applies to our representatives.

10. Ending the contract on our side

We may end the contract with at least 30 days’ notice, for example if we discontinue BlastRev; you then keep access until the end of your paid period, and we send you your quiz content on request. Either side may end the contract immediately for good cause.

11. Changes to these terms

We will tell you about changes at least 30 days before they take effect, by email or in the app. If you object within that time, the old terms continue to apply and either side may cancel. Changes never apply to periods you have already paid for.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant (Kaufmann), a legal entity under public law or have no general place of jurisdiction in Germany, the place of jurisdiction is Lüdenscheid; we may also sue at your place of business. Should a provision be invalid, the rest of these terms remains valid.
